The TGI Ouaga 1 has denied the words of the lawyers of the former minister Vincent Dabilgou, affirming Wednesday during a press conference, that the prosecution traced their communications with their client.

In a press release, Prosecutor Harouna Yoda indicated that the former minister violated the prescriptions of his police custody by communicating with the outside via his mobile phone.

According to Mr. Yoda, an expert appointed by the justice was responsible for extracting the conversations that Vincent Dabilgou would have had with witnesses in the case.

The Prosecutor assures that throughout the procedure, there was never any question of tracing the communications between the lawyers and their client.

The lawyers believe that it is the High Court of Justice which must hear the former minister and not the TGI.

But for Mr. Yoda, this request was taken into account because the TGI decided to join the exception to the merits and that the debates should allow him to declare himself on his own competence in accordance with article 138 of the Constitution.

Also the prosecution is surprised that the lawyers are talking about arbitrary detention when they have not presented any documents before the court or requested provisional release for Mr. Dabilgou, accused of secret financing of a political party, embezzlement of public funds and money laundering.

In addition Harouna Yoda rejected the political nature of the trial, considered according to him, as a lack of regard for the intelligence of the Burkinabe judiciary.

“In any case, the prosecution points out that the outrageous statements contrary to the reality of the facts made during the press conference do not benefit from immunity from legal proceedings”, warned the magistrate.
