Approval by the Council of Government of the draft decree relating to tourist accommodation establishments

Rabat – The Government Council, held on Thursday, January 5, approved the draft decree n°2.22.867 approving the general construction regulations (RGC) setting the construction standards specific to tourist accommodation establishments and establishing the National Committee construction standards specific to tourist accommodation establishments.

During the presentation of the said draft decree, the Minister of National Territorial Development, Urban Planning, Housing and City Policy, Fatima Ezzahra El Mansouri, specified that this text of law comes into application of article 4 of law 80.14 relating to tourist establishments and other forms of tourist accommodation which stipulates the establishment of specific building regulations for tourist accommodation establishments by regulation. The latter must lay down, in particular, the safety rules that the constructions must respect as well as the conditions that they must satisfy in the interest of hygiene, traffic and public convenience.

“The main contribution introduced by this draft decree consists in setting the dimensional and functional construction standards with which any project for the construction, transformation, extension of a tourist accommodation establishment or conversion of a existing building in a tourist accommodation establishment”, argued Ms. El Mansouri, quoted in a press release from the Ministry of National Territorial Planning, Town Planning, Housing and City Policy.

And to add that “this general regulation does not impact tourist accommodation establishments existing before the date of its entry into force. Moreover, it has been concerted and approved by professionals in the sector, namely the National Federation of the hospitality industry”.

The draft decree aims to achieve several objectives, including the relaxation of administrative procedures relating to the awarding of classification by merging the provisional technical classification provided for by Law No. 61.00 on the status of tourist establishments with the procedure for granting the building permit provided for by the legislative and regulatory texts governing the field of town planning. This relaxation will make it possible to reduce the time for processing and obtaining the two administrative decisions, while ensuring compliance with criteria in terms of town planning, construction, safety and dimensional and functional hotel standards.

The approved draft decree also aims to lock compliance with classification standards by any tourist accommodation establishment upstream of the construction phase, on the occasion of the granting of the building permit, to compensate for the informal in s Ensuring that promoters build their establishments in accordance with the required criteria and to provide investors or promoters of tourism projects with a reference system to enhance the quality of tourist accommodation establishments.

Thus and in order to achieve the aforementioned objectives, the statement specifies, the draft decree has also established the National Committee for Construction Standards specific to tourist accommodation establishments which will be responsible, on the one hand, for assessing compliance with the standards of dimensional and functional construction provided for in the general regulations, attached to the draft decree and on the other hand, to propose, instruct and give its opinion on the draft amendments to these general regulations.

It should be noted that, in accordance with the High Royal Guidelines, all these measures aim to simplify the procedures related to the granting of the building permit in order to encourage real estate investment in the tourist sector, to reinforce the quality requirements and ensure economic recovery.
